FCRA Disclosure & Authorization

Standalone disclosure under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.

Disclosure

BreakCheck ("we", "us", or "our") may obtain a consumer report (commonly referred to as a "background check") about you from Checkr, Inc., a consumer reporting agency, in connection with your application for BreakCheck Certified status.

The consumer report may include information about your criminal history (including arrests and convictions), sex offender registry status, global watchlist and sanctions screening, and other publicly available records. The exact scope of the report depends on the package ordered and applicable state law.

This disclosure is provided in accordance with the FCRA, 15 U.S.C. § 1681b(b)(2)(A), which requires that we disclose to you, in a document consisting solely of the disclosure, that a consumer report may be obtained for employment or other purposes.

The consumer report will be used solely to evaluate your eligibility for BreakCheck Certified status. It will not be used for any other purpose without your separate authorization.

Your Rights Under the FCRA

You have important rights under the FCRA, including:

  • The right to know what is in your consumer report. You are entitled to a free copy of your consumer report from Checkr upon request.
  • The right to dispute inaccurate or incomplete information. If you believe any information in your report is inaccurate or incomplete, you may dispute it directly with Checkr.
  • The right to be told if information in your report has been used against you. If BreakCheck takes adverse action based in whole or in part on information in your consumer report, we will notify you and provide you with contact information for Checkr.
  • The right to a summary of your rights. A full summary of your rights under the FCRA is available at the Consumer Financial Protection Bureau: consumerfinance.gov/learnmore.
  • The right to seek damages. If a consumer reporting agency, or, in some cases, a user of consumer reports or a furnisher of information to a consumer reporting agency, violates the FCRA, you may be able to sue that entity in state or federal court.

Authorization

By providing your authorization during the BreakCheck Certified application process, you:

  • Authorize BreakCheck to obtain one or more consumer reports about you from Checkr, Inc.
  • Authorize this report to be used for the purpose of evaluating your eligibility for BreakCheck Certified status.
  • Understand that this authorization covers the initial application and any subsequent annual renewal requests.
  • Understand that you may revoke this authorization at any time by withdrawing your application; however, BreakCheck may not be able to process or renew your certification without it.
  • Acknowledge that you have received a Summary of Your Rights Under the Fair Credit Reporting Act.

This disclosure page constitutes the standalone FCRA disclosure document as required by 15 U.S.C. § 1681b(b)(2)(A). It contains no extraneous information other than the required disclosure.
